6. 1. C. - Page 26 B. Staffing Skilled and competent workers shall perform all work in a timely, neat, and orderly manner. City may refuse to accept work or workers who do not meet these standards. Contractor shall be responsible for any damage caused by their operations and shall repair or replace, as directed by the City, said damage within a reasonable time. The Contractor shall also maintain and provide direct phone numbers, cellular phone numbers, and email addresses of key staff with whom the City can maintain regular and direct contact regarding scheduling, billing, status reports, and other items. C. Contractor's Shop The Contractor shall have or establish adequate shop and storage facilities. Contractor's facility shall house the necessary equipment and materials for repair and maintenance of the City's storm water pumps. D. Contractor's Equipment The Contractor is responsible for having all equipment necessary to perform the work described in Attachment A — Scope of Services. Contractor's staff must be experienced and capable of operating such equipment, and Contractor must maintain Contractor's equipment in good working order. E. City's Right to Inspect and Require Work The City of Redwood City reserves the right to make such inspections whenever necessary to ascertain that the requirements of this agreement are being fulfilled. Deficiencies noted shall be promptly corrected at Contractor's expense. Notwithstanding the separate Liquidated Damages clause, if Contractor fails to perform the work required by the terms of the agreement in a diligent and satisfactory manner, the City may, after 30 days' written notice to Contractor, perform or cause to be performed, all or any part of the work required hereunder. Contractor agrees that it will reimburse the City, and the City may deduct the amount from any sum owed Contractor. The waiver by the City of a breach of any provision of this agreement by Contractor shall not operate or be construed as a waiver of any subsequent breach by Contractor. F. Guarantee and Warranty of Work The Contractor shall guarantee all work performed under the agreement against defects resulting from the use of substandard materials, equipment or workmanship one year from the date of service. During the warranty period for any new equipment installation, the Contractor shall be responsible for making contact between the equipment manufacturer and the City regarding any required service determined to be under warranty.
