The burden of proof of extreme emergency or exceptional <br />unforeseen circumstances shall be upon the employee. <br />9.1.3 9.'-r4-- — An employee may elect to receive compensation in lieu of sick leave <br />credits for any calendar year (based on the pfirst twenky-six (26) pay <br />periods in the calendar ,year) by requesting payment of unused sick leave in writing <br />to the Director of Finance on or before December 1 of the prior year. <br />Payment shall be made at twenty-five percent (25%) of the valu unused sick leave <br />hours accrued in the calendar year. <br />Payment shall be made at fiftypercent (50%) of the unused sick leave (50%hours <br />accrued in the calendar year when no more than twelve and one half (12.5) hours <br />of sick leave have been used)4er in the first tweet -six (26) pay periods. <br />The City will endeavor to make payment on the non -payroll Friday immediately <br />following the first payroll Friday in January following the year in which the leave <br />is accrued; however the payment will be made no later than the first pay period in <br />February and shall be paid using the salary in effect December 31. There shall be <br />no payment in lieu of accumulated sick leave benefits for years prior to such <br />calendar year. <br />_Use of Personal Business Leave shall be excluded from the definition of sick leave <br />usage for the purposes of calculating sick leave buyouts. <br />Accumulated sick leave credits shall be reduced by the value of the sick leave <br />compensated as provided in the above paragraph and the remaining balance shall <br />be accumulated to a maximum of one thousand three -hundred and seventy <br />(81,370) hours in accordance with Section 9.1.1. <br />If an employee ten:ninatesUyon separation from City service for reason other than <br />death, retirement or discharge, compensation in lieu of unused, accrued sick leave <br />shall be paid in aeear-d Hee ... he tenn amount provided in Section 9.1.4 for an <br />employee who may el elects to receive compensation in lieu of sick leave credits, <br />prorated to the date of termination of service. <br />Employees with twenty (20) years of service with the City, who retire from City <br />employment with benefits from PERS, shall be eligible to receive compensation <br />for fifty percent (50%) of accrued unused sick leave. <br />Employees who die while in the employ of the City shall be eligible to receive <br />compensation for twenty-five percent (25%) of accrued sick leave. <br />23 <br />
