6.D. - Page 3 of 70 Step 2: The LPA publishes a Request for Proposal (RFP). Here, PPA published a notice of solicitation (No. 1510) in 2013 with specific weighted criteria including favorable pricing for various law enforcement equipment among other things. Step 3-5: The LPA evaluates responses and awards a contract based on the RFP criteria resulting in a Master Price Agreement (MPA) which contract is then made available. Here, an MPA with Axon Enterprises was found to be the lowest responsible bidder. The current MPA (Attachment 2) was entered into on June 11, 2018. The discounted pricing is available until 10/28/21 under the cooperative purchasing provision of the Public Procurement Authority (Contract Number VH11630, as amended). Step 6: NPPGOV members can "piggyback" off the MPA by signing an Intergovernmental Agreement with the LPA. Members can then make purchases. Here, the City may take advantage of this favorable pricing for CEWs by executing the Participating Agency Endorsement and Authorization to the Intergovernmental Agreement and authorizing the expenditure. Staff recommends entering into the participating Agency Endorsement and Authorization to Intergovernmental Purchasing Agreement and piggybacking off the contract between the Public Procurement Authority and Axon Enterprise, Inc. to purchase 125 CEWs and the required accessories including holsters, batteries, and cartridges. Staff believes that the findings under Municipal Code Section 2.80 may be made for the following reasons: 1. Staff has reviewed the Public Procurement Authority competitive bidding process, and confirmed that their competitive bidding requirements are substantially equivalent to those required by the City Charter or the Purchasing Ordinance of the City and 2. Staff reviewed the pricing for services obtained by The Public Procurement Authority and found the prices to be competitive and reasonable, ensuring value is obtained for the City FISCAL IMPACT Funding for the $202,935.13 purchase already exists within the Police Department's budget. Approval of this expenditure will have no increase or fiscal impact to the City, other than that which was previously anticipated, and for which funds were budgeted. ENVIRONMENTAL REVIEW This is not a project under California Environmental Quality Act (CEQA) as defined in CEQA Guidelines, Section 15378, because it has no potential for resulting in either a direct or foreseeable physical change in the environment.
