Removal of Elevators from Service Contractor will coordinate and obtain written approval from the Facilities Supervisor before removal of any elevator(s) from service. In the event major repair work becomes necessary, Contractor will provide separate repair personnel to accomplish the work to ensure that regular service personnel continue with their normal preventive maintenance of the equipment. K. Performance of Contractor General: Contractor shall ensure that only skilled and competent workers shall perform all work in a timely, neat, and orderly manner. City may refuse to accept work or workers who do not meet these standards. Contractor shall be responsible for any damage caused by Contractor's operations and shall repair or replace, as directed by the City, said damage within a reasonable time. 2. Down Time: If an elevator is inoperative for more than fifteen (15) minutes, Contractor shall post a sign at each entrance indicating that the elevator is out of service. City's Right to Inspect and Require Work: The City reserves the right to make such inspections and tests whenever necessary to ascertain that the requirements of this Agreement are being fulfilled. Contractor shall promptly correct any noted deficiencies at Contractor's expense. If Contractor fails to perform the work required by the terms of this Agreement in a diligent and satisfactory manner, the City may, after thirty (30) days' written notice to Contractor, perform or cause to be performed, all or any part of the work required hereunder. Contractor agrees that it will reimburse the City, and the City may deduct the amount from any sum owed to Contractor. The waiver by the City of a breach of any provision of this Agreement by Contractor shall not operate or be construed as a waiver of any subsequent breach by Contractor. H. Payment Terms Contractor shall provide the services outlined herein for a not to exceed amount of $55,000.00 per the fee schedule below.
