failure or delay, Contractor agrees that it shall be liable for and pay to the City liquidated <br />damages of two hundred dollars ($200.00) for each thirty (30) minute delay beyond the <br />acceptable response time. Contractor agrees to pay said liquidated damages as herein <br />provided, and in case the same are not paid, agrees that City may deduct the amount <br />thereof from monies due or that may become due to the Contractor. <br />2. In the event of non -emergency calls during working hours, the Contractor shall provide <br />service within three (3) hours of placement of the call by the City. Upon approval by the <br />Facilities Supervisor, additional time may be allowed. If the call comes in during non- <br />working hours, the Contractor shall respond by 10:00 a.m. the next business day. Since <br />the determination of actual damages for any failure or delay in performance of this <br />requirement would be extremely difficult or impractical to determine in the event of such <br />failure or delay, Contractor agrees that it shall be liable for and pay to the City liquidated <br />damages of one hundred dollars ($100.00) for each eight (8) hour delay beyond the <br />allowed time. Contractor agrees to pay said liquidated damages as herein provided, and in <br />case the same are not paid, agrees that City may deduct the amount thereof from monies <br />due or that may become due to the Contractor. <br />3. All elevator service personnel responding to service requests or emergency calls shall <br />contact City Facilities Staff upon arrival at the facility. The check-in procedure shall be <br />to call the Facilities Help Line at (650) 780-7473 during working hours, or for after <br />regular working hours emergencies to call Communications at (650) 780-7118 and <br />request that they notify a Facilities Maintenance staff person. <br />I. Schedules and Records <br />1. Contractor shall submit preventative maintenance work schedules to the City. These work <br />schedules shall be designed for each type of equipment to be serviced, such as traction <br />elevators or hydraulic elevators, and shall conform to the manufacturer's recommended <br />practice for the particular equipment. The schedules shall also show the type and <br />frequency of service and lubrication proposed by Contractor. The City will evaluate and <br />approve the proposed maintenance schedules before work may commence. <br />2. Contractor shall perform all inspections, lubrication, adjustments, tests, cleaning, routine <br />repairs, and other preventative maintenance activities in accordance with the approved <br />maintenance schedules. <br />3. Contractor shall keep these work schedules on display in each equipment room. <br />Schedules posted shall be of the chart type, which shall be initialed by the service person <br />when each scheduled inspection is performed. <br />4. Contractor shall provide an activity log in a permanently bound journal with pre - <br />numbered pages, and keep the log current. The log is to be kept in the machine room and <br />available for review by City staff. The activity log is the property of the City. The activity <br />log will be complementary to the maintenance and lubrication logs. Entries will identify <br />who from the Contractor's organization was in the building, during what period of time, <br />and for what purpose (e.g. regular maintenance, regular time call-back, overtime call- <br />back, etc.). Equipment failures, passenger entrapments or unusual maintenance situations <br />are to be noted and require the insertion of a brief explanatory entry. <br />5. Contractor shall fill out a service/repair tag for each billable repair that is not part of this <br />Agreement.
