3.7 Vehicle Maintenance. There shall be no maintenance performed on any vehicle except for <br />any emergency repairs that are necessary in order to move the vehicle to a proper repair facility or as <br />authorized by the Board in writing. <br />3.8 Alterations. Modifications or Additions. There shall be no alterations, modifications or <br />additions made to any Lot or any Improvement thereon except in compliance with Applicable Laws. <br />3.9 Compliance with Law. No Owner shall permit anything to be done or kept in his or her Lot <br />that violates any Applicable Laws. Nothing shall be done or kept in any Lot that might increase the rate of or <br />cause the cancellation of any insurance maintained by the Association. <br />3.10 Drilling. No drilling, mining, or quarrying operation shall be conducted on any Lot or the <br />Common Area at any time. <br />3.11 Post Tension Concrete Slab System. The residences have been constructed using a post <br />tension concrete slab system ("System"), which involves placing a grid of steel cables under high tension in <br />the concrete slab foundation of each residence. Any attempt to modify, alter or otherwise tamper with the <br />foundation (for example, saw cutting, drilling or installation of a subterranean safe) is very hazardous and <br />might result in serious injury or damage. No Owner or Occupant of any Lot shall: (i) cut into or otherwise <br />tamper with the System; or (ii) knowingly permit or allow any other Person to cut into or tamper with the <br />System. In addition, the Owner shall disclose the existence of the System to any Occupant of the residence. <br />Any disturbance of the System shall occur only after consultation with a qualified consultant. <br />3.12 Cordilleras Creek Setback. Other than the property line fencing, there shall be no structures <br />or impervious surfaces located within the 25 -foot creek protection setback located on Lots 1 through 4 shown <br />in Exhibit B. Fencing may not extend beyond the top of the bank of Cordilleras Creek. City approvals for the <br />Development expressly prohibit any impervious structures and impervious surfaces within the 25 -foot creek <br />protection setback located on Lots 1 through 4 as shown in Exhibit B. <br />3.13 Encroachment Permit Requirements. Construction activity within Liberty Hall Lane or any <br />easement in which the City has an interest shall require an Encroachment Permit from the City in accordance <br />with the City's Code. <br />ARTICLE 4 <br />Maintenance Obligations <br />4.1 Owner's Maintenance Obligations. Each Owner shall maintain the Owner's Lot and all <br />Improvements described in Sections 4.1.1 through 4.1.8 in good condition and repair (ordinary wear and <br />tear excepted) and in compliance with the Homeowner's Manual described in Section 4.1.9, the Stormwater <br />Agreement described in Section 2.11, the Landscape Maintenance Agreement described in Section 2.12, <br />and commonly -accepted homeowners' maintenance obligations. <br />Each Owner shall allow agents of the Association access to the Owner's Lot for purposes of <br />performing the Association's maintenance obligations under this Declaration. If any Owner fails or refuses to <br />provide access, the Owner shall be responsible for any maintenance costs that could have been avoided if <br />access had been provided, and the Association may levy a reimbursement assessment against the Lot to <br />recover the additional costs. <br />If any Owner fails to maintain his or her Lot as required herein, the Association, after notice and <br />hearing as described in the Bylaws, may, but is not obligated to, enter the Lot and perform the necessary <br />maintenance.
