4.1.1 Residence. Each Owner shall maintain the residence on the Owner's Lot, including <br />the foundation, siding, trim, windows, doors and roof and all interior Improvements. <br />The exterior surfaces of the residences (including the siding, rain gutters, and downspouts) shall be <br />periodically repainted and the roof materials periodically replaced in accordance with a schedule that <br />maintains substantially the same quality of appearance as existed at the time original construction was <br />completed and no less Frequently than the periodic repainting and re -roofing recommendations of the <br />manufacturer and/or the Homeowner's Manual described in Section 4.1.9. In addition, each residence shall <br />be periodically inspected for construction material destroying pests or organisms and, if necessary, immediate <br />appropriate corrective action shall be taken therefor. <br />In order to reduce the potential for water damage (including mold growth) within the residence, each <br />of the following steps shall be performed: (i) periodic inspection of the residence for water leaks, other <br />evidence of water intrusion (such as condensation on the windows or walls, water stains or other types of <br />water damage) and for the presence of molds, fungi and their spores (collectively "Mold"); (ii) if any water <br />leaks, water intrusion and/or Mold are detected, immediate notification to the Association and, if applicable, <br />appropriate corrective steps to repair the leak and/or reduce water intrusion and repair any resulting water <br />damage (including the removal of any Mold); (iii) maintenance of proper ventilation (particularly in the <br />bathrooms) and humidity levels to reduce the risk of water damage (including Mold growth); (iv) periodic <br />inspection of refrigerator condensation pans, air conditioners (if applicable) and any other water -retaining <br />appliances to ensure they are properly functioning and not leaking water or otherwise creating water damage <br />to the residence (including Mold growth); (v) periodic inspection of carpeting or similar types of floor covering <br />in bathrooms that may be conducive to Mold growth; (vi) replacement of heating and airconditioning filters not <br />less frequently than quarterly or as recommended by the manufacturer; and (vii) such other prudent steps as <br />may be appropriate to prevent water leaks and water intrusion and to repair all leaks, sources of water <br />intrusion and water damage (including Mold growth) within the residence. <br />4.1.2 Utilities. Each Lot Owner shall maintain any utility line or equipment that exclusively <br />serves the Lot, including any portion of an interconnected system such as a lateral plumbing, water, or gas <br />pipe exclusively serving the Lot. No Owner shall excavate, alter or otherwise disturb any Improvement or <br />landscaping on any other property without the prior written consent of that property Owner. If the property is <br />Common Area, the Association may require the Owner to comply with such terms and conditions as the <br />Board may direct prior to commencement of any work within any Common Area. <br />4.1.3 Drainage System. Each Owner shall maintain that portion of the drainage system <br />located on the Owner's Lot in compliance with the applicable Stormwater Agreement described in <br />Section 2.11 and Exhibit D. <br />4.1.4 Landscaping and Irrigation Obligations. Each Owner shall maintain the landscaping <br />on the Owner's Lot. Landscaping shall be maintained in a healthy and weed -free condition. Dying or dead <br />vegetation shall be immediately removed and replaced. Maintenance shall include regular fertilization, <br />mowing, irrigation, pruning, elimination of pests or diseases, and other customary prudent landscaping <br />practices. All lawns shall be kept neatly mown and trees neatly trimmed and pruned at all times. <br />4.1.5 Stormwater Treatment Measures. Each Owner shall maintain the stormwater <br />treatment measures on their Lot, including bioswales, permeable paver driveways, walkways and patios in <br />compliance with the applicable Stormwater Agreement described in Section 2.11 and Exhibit D. <br />4.1.6 Screening Trees on Lots 1 and 8. Screening trees have been installed along the <br />southwest boundary of Lots 1 and 8 and the Lands of Collins at 90 Finger Avenue shown on the Map. Two <br />years after the installation of the trees, the Lot 1 and Lot 8 Owners shall provide documentation to the City to <br />demonstrate that the trees have reached a minimum of 16 feet in height and have achieved the desired <br />screening effect. The City may require the Lot 1 and Lot 8 Owners to install additional landscape plantings <br />should the trees not achieve the desired screening effect within two years following installation. <br />EDNB\53295\996553.3 9 August 18, 2016 <br />
