F. City Inspection of Work: City staff reserve the right to inspect Contractor's work. Contractor will promptly correct any deficiencies at Contractor's expense. Notwithstanding the separate Liquidated Damages clause, if Contractor fails to perform the work required by the terms of the Agreement in a diligent and satisfactory manner, the City may, after 30 days' written notice to Contractor, perform or cause to be performed, all or any part of the work required hereunder. Contractor will reimburse the City, and the City may deduct the amount from any sum owed to Contractor. G. Guarantee and Warranty of Work: The Contractor shall guarantee all work performed under the Agreement against defects resulting from the use of substandard materials, equipment or workmanship for one year from the date of service. H. During the warranty period for any new equipment installation, the Contractor shall be responsible for making contact between the equipment manufacturer and the City regarding any required service determined to be under warranty. The Contractor will notify the City of any undue delays in response and provide details of each incident. 2. Payment Terms Contractor shall provide the services outlined above on a per task basis not to exceed $515,000.00. Fees will be billed based on actual hours and materials used per the rate schedule as delineated below. Task 1: Preventative Maintenance Unit Unit Rate Per Pump $275.00 Frequency Annually Task 2 and 3: Major Repairs, On -Call and Emergency Repairs Equipment Rates: Equipment Service Truck Auto Crane 17 Ton Crane Truck 28 Ton Crane Truck Larger Cranes Unit Rate $40.00 / Hour $60.00 / Hour $100.00 / Hour $120.00 / Hour Quoted based on job Labor Rates: Class Regular Rate Lead Operator $75.00 / Hour Helper $60.00 / Hour Regular Rates shall apply weekdays Rates shall apply to all calls serviced weekends. Overtime Rates shall also during a single 24 hour period. REV: 10-04-19 EI Overtime Rate $112.50 / Hour $90.00 / Hour during the hours of 8:30 A.M.- 4:00 P.M.
