H().1:orable Ma'yor and City Oouncil <br /> I=romthe Oity Manage.r <br /> April 24, 2006 <br /> Subject <br /> By motion, approve and authorize execution of Amendment No.2 (that extends and <br /> amends the agreement dated September 20, 2005 and rescinding Amendment No.1, <br /> dated February 6, 2006 (the "Agreement")) to allow Wagstaff & Associates to prepare a <br /> Supplemental Environmental Impact Report (SEIR) for Stanford Hospital & Clinics <br /> proposed Ambulatory Medical Clinics Project located at 420,430,440 and 450 Broadway. <br /> Recommendation <br /> That the City Council approve and authorize execution of the amended agreement for <br /> environmental consulting services with Wagstaff & Associates for the Stanford Medical <br /> Clinics Project SEIR. <br /> Background <br /> On or about September 20,2005, Planning Services selected Wagstaff and Associates to <br /> prepare a Mitigated Negative Declaration for the Stanford Project that would tier off of the <br /> Midpoint Technology Park campus EIR previously certified by the Planning Commission. <br /> The proposed Stanford Project will be located within a portion of the 42-acre Midpoint <br /> Technology Park campus. Wagstaff's original proposal was for $59,439 and so this <br /> agreement did not come before the City Council for approval. <br /> On or about February 6,2006, Planning Services entered into Amendment NO.1 of the <br /> September 20,2005 agreement whereby Wagstaff and Associates would expand their <br /> work to undertake a Supplemental EIR instead of a mitigated negative declaration for the <br /> Stanford Medical Outpatient Center Project. After reviewing data on potential traffic <br /> impacts of the project, City and Stanford staff agreed to undertake a Supplemental EIR in <br /> order to ensure that all potential project-related environmental impacts are adequately <br /> analyzed. The cost of said Supplemental EIR for the Project was established as the not to <br /> exceed amount of $71,699.00. <br /> However, the total amount should have been a not to exceed amount of $131,138 <br /> (=$59,439 + $71,699). Consequently, Planning Services and Wagstaff and Associates <br /> desire to rescind Amendment NO.1 in order that the true cost of all work to be performed by <br /> Consultant will reflect the correct sum of $131,138.00. <br /> The Stanford Project involves the renovation of four existing commercial buildings (built in <br /> 1998) located within an 11-acre portion of the larger 42-acre Midpoint Technology (office <br /> R&D) Park campus for a new Medical Outpatient Center.
