6.E. - Page 2 of 34 <br />prepared a Parcel Map to merge the vacated portions of Walnut Street into Kaiser's existing properties <br />on either side of the street. Additionally, during its preparation of the Parcel Map, it was discovered that <br />a public utility easement bisects the Kaiser campus even though the easement is no longer in use. <br />The Kaiser Precise Plan, approved by the City council in 2003, was amended in 2010 to adjust setback <br />requirements, street frontage improvements, and the location of vehicular access points to the Kaiser <br />Campus. In particular, the 2010 amendment facilitated public access to the Phase 1 Hospital <br />Replacement Project from Marshall Street via Marshall Court, what was then a cul-de-sac providing local <br />access to structures on Marshall Court only. <br />While reviewing construction documents for the Phase 1 Hospital Replacement Project, staff worked <br />with Kaiser to study the abandonment of the cul-de-sac portion of Marshall Court so that Kaiser could <br />better reconfigure the area as an access point to the campus. On May 24, 2010, the City Council <br />approved a Revocable Encroachment Permit to facilitate hospital construction and to provide Kaiser <br />sufficient time to determine the underlying fee ownership of Marshall Court prior to its abandonment. <br />Since that time, the underlying fee ownership was found not to be held by Kaiser, and Kaiser is no longer <br />seeking abandonment of Marshall Court. In addition, on January 25, 2016, the requirement to prepare a <br />tentative parcel map was waived (Attachment 3). <br />0L1M%,MV <br />Kaiser has completed the construction of improvements in accordance with the Agreement, the plans <br />and specifications, and to the satisfaction of the City's Engineering and Transportation Division. Kaiser <br />provided faithful performance and labor and material ("payment") bonds in the amount of $4,991,981. <br />Maintenance (warranty) bonds will be held for a one-year period, in the event that any of the <br />improvements fail within that time. <br />Upon recordation of the Parcel Map, the public utility easement bisecting the Kaiser campus would be <br />abandoned. Additionally, the previously -abandoned portions of Walnut Street would become part of the <br />larger Kaiser parcel. Marshall Court would not be affected. <br />Finally, the Grant of Revocable Encroachment Permit is intended to supersede the 2010 Revocable <br />Encroachment Permit and would allow Kaiser to keep certain communication and storm drain lines <br />under the cul-de-sac portion of Marshall Court, and under a portion of Maple Street. <br />FISCAL IMPACT <br />There is no fiscal impact to the City as a result of this action. <br />ENVIRONMENTAL REVIEW <br />In 2003, the City Council certified an EIR that reviewed the potential environmental impacts with the <br />buildout of the Downtown Medical Campus Precise Plan.
