6.B. - Page 2 of 22 <br />Engineer recommends aesthetic standards and placement of wireless facilities to the City Council (Sec. <br />29.104), replacing "Denial for Incompleteness" with "Rejection for Incompleteness" (Sec. 29.106), and <br />requiring all final decisions on an application to be in writing, not just denials (Sec. 29.107). The updates <br />to the resolution include: adding a potential waiver for undergrounded utilities (Sec. 3), explaining when <br />installation of equipment on strands or supporting wires is permitted (Sec. 7), and clarifying noise <br />emission requirements (Sec. 14). <br />Updates to the ordinance and resolution are necessary to provide further clarification on the regulation <br />of wireless facilities in order to be compliant with the new Federal Communications Commission (FCC) <br />order. The attached ordinance and resolution contain text in underlined or strikethrough format to show <br />the updated language as distinguished from the versions previously presented to Council. <br />FISCAL IMPACT <br />Presently, the City is required under the California Constitution to charge market rates for private and for- <br />profit use of City property. The current regional market lease rate is approximately $1,500 per year per <br />pole, which is a reasonable approximation of the costs incurred. If lease rates for City -owned poles were <br />capped at an artificially low level of $270 as the recent FCC ruling intends, the City could lose a significant <br />amount of revenue; the exact amount of potential revenue loss is unknown at this time and would depend <br />upon the number of new sites installed in the ROW. <br />ENVIRONMENTAL REVIEW <br />This ordinance is not a project within the meaning of Section 15378 of the State of California <br />Environmental Quality Act ("CEQA") Guidelines because it has no potential for resulting in physical change <br />in the environment, directly or indirectly. The ordinance does not authorize any specific development or <br />installation on any specific piece of property within the City's boundaries. Moreover, when and if an <br />application for installation is submitted, the City will at that time conduct preliminary review of the <br />application in accordance with CEQA. <br />PUBLIC NOTICE <br />Public Notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />The City Council may elect to not reintroduce and adopt the Ordinance Amending Municipal Code <br />Chapter 29 to Add Article "Wireless Facilities in Public Rights -of -Way" and Resolution Establishing <br />Aesthetic Standards for Wireless Facilities in the Public Rights -of -Way. <br />ATTACHMENTS <br />Attachment A: Wireless Rights -of -Way Ordinance <br />Attachment B: Chapter 29, Article VIII — Wireless Facilities in Public Rights -of -Way (Exhibit A to <br />ordinance) <br />City of Redwood City 1017 Middlefield Road, Redwood City, CA. 94063 Tel: 650-780-7000 www.redwoodcity.ore <br />42 <br />
