6.D. - Page 42 of 170 <br />Request for Qualifications: <br />General Park Building Construction, Retrofit, Maintenance, and/or Repairs <br />Before commencing any work, the Contractor shall submit to the Department for approval the name, address, <br />telephone number and contract amount of all Subcontractors and sub -subcontractors and a description of each portion <br />of the work to be subcontracted. <br />ARTICLE 13 <br />PRIOR NOTICE OF IMPENDING LABOR DISPUTE <br />Whenever the contractor has knowledge that any actual or potential labor dispute involving employees or supplier is <br />delaying or threatens to delay the timely performance of this contract, the contractor shall immediately provide written <br />notice, including all relevant information to the CITY. <br />ARTICLE 14 <br />PERFORMANCE BOND <br />If required by City staff, the successful Contractor shall provide a Performance Bond in the amount equal or greater than <br />the Contractor's winning bid amount unless otherwise specified. If required, Contractor will not be allowed to enter the <br />project site until a valid performance bond is submitted to the City. If required, the Contractor must maintain a Performance <br />Bond for each project Contractor is awarded. Performance bond must be current and valid until the project is completed to <br />the satisfaction of the City. <br />NOTE: Bonds must be obtained from an insurance company with a Certificate of Authority from the California Insurance <br />Commissioner authorizing the company to write surety insurance within the State of California. <br />14.1 PERFORMANCE BOND <br />The awarded Contractor/s may be required to maintain a minimum performance bond in the amount or greater than <br />the awarded bid dollar amount unless otherwise specified. If required, a faithful performance bond shall be executed <br />by Contractor and by a responsible corporate surety company prior to the entry and start of any as -needed projects. <br />The form of bond for the faithful performance of the contract shall be such that the CITY may proceed against <br />Contractor immediately upon default in the performance of the Contract as defined in this agreement. <br />Evidence of the faithful minimum performance bond shall be presented to RAP'S Contract Administrator for this <br />contract. A City performance bond form can be found on-line at http://cao.laciiy.or risk/1- <br />ContractorsPerformanceBond.pdf. The sum herein stipulated shall serve as security for faithful performance of all <br />covenants, promises and conditions assumed by Contractor herein, and may be applied in satisfaction and/or <br />mitigation. Contract Clauses of damages arising from a breach thereof, including, but not limited to delinquent <br />payments, correction of maintenance deficiencies, securing required insurance, loss of revenue due to abandonment, <br />vacation or discontinuance of concession operations, and payment of mechanic's liens. Application of the amounts on <br />deposit in satisfaction and/or mitigation of damages shall be without prejudice to the exercise of any other rights <br />provided herein or by law to remedy a breach of this agreement. <br />In the event any or all of said amount is applied in satisfaction and/or mitigation of damages, Contractor shall <br />immediately deposit such sums as are necessary to restore the security deposit to its full amount. Said sum, less any <br />amount that may be withheld there from by the CITY, shall be returned to Contractor thirty (30) days after termination <br />or expiration of this agreement unless the reason for case, the Department reserves the right to retain the performance <br />bond or any portion thereof required to satisfy and/or mitigate the damages caused by the breach. <br />IMPORTANT — RESPONDERS MUST SUBMIT ALL REQUIRED FORMS (COMPLETELY FILLED OUT) BY RFQ <br />SUBMITTAL DEADLINE. <br />Page 36 of 103 <br />125 <br />
