6.H. - Page 7 of 8 <br />6.3.A. - Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />March 26, 2018 <br />SUBJECT <br />Redwood City Municipal Code amendment regarding disposition of unclaimed property <br />RECOMMENDATION <br />By motion, waive first reading and introduce an ordinance amending Article VI of <br />Chapter 2 of the Redwood City Municipal Code regarding disposition of unclaimed <br />property <br />BACKGROUND <br />Redwood City Municipal Code Section 2.55 currently requires the Police Department to <br />keep unclaimed property a minimum of four consecutive months, with the exception of <br />bicycles, which must be kept for three consecutive months. <br />California Civil Code Sections 2080 through 2080.10 provides that found property be <br />held for a minimum 90 days and property held for the purposes of temporary <br />safekeeping be kept for a minimum of 60 days. <br />Currently, RCMC Section 2.55 allows for the donation of bicycles or toys which have <br />been unclaimed for a period of at least 60 days, however, the governing state law that <br />authorizes release of unclaimed property for donation purposes has changed and now <br />requires a passage of at least 90 days prior to any donation. <br />ANALYSIS <br />The population of Redwood City is approximately 30,000 persons greater than what it <br />was when RCMC Section 2.55 was created. As of March 2017, the Redwood City <br />Police Department's Property and Evidence Storage room was at 92% capacity. <br />Although the Police Department strives to purge at least one item for each new item <br />received, that has become increasingly difficult to do since the court system is <br />extending prosecution timelines due to court backlogs. Staff expects the Property and <br />Evidence Storage Room will run out of capacity by the end of 2018. Accordingly, the <br />Police Department is exploring all available solutions to reduce the number of stored <br />items before considering costly offsite storage solutions. Updating RCMC Section 2.55 <br />meets that goal at no cost to the City. <br />By amending RCMC Chapter 2 Article VI to allow the City to be governed by California <br />Civil Code Sections 2080 through 2080.10 with respect to the disposition of property, <br />104 <br />
