6.D. - Page 4 of 6 <br />• One Marina CFD Project Fund <br />• California Marina —Traffic Mitigation <br />• Traffic Mitigation Fees Fund <br />• Gas Tax Construction Fund <br />No additional budget appropriation is needed to award the contract agreement. <br />ENVIRONMENTAL REVIEW <br />The proposed contract award is consistent with a previously -approved mitigated negative declaration. On <br />April 25, 2016 City Council adopted Resolution No. 15488 adopting the U.S. Highway 101 Pedestrian <br />Undercrossing and Bair Island Road Storm Drain Pump Station Project initial study and mitigated negative <br />declaration and a mitigation monitoring and reporting plan all in accordance with the requirements of the <br />California Environmental Quality Act, and approving the U.S. Highway 101 Pedestrian Undercrossing <br />Project Design. <br />This project will also adhere to requirements of all applicable permits, including but not limited to: <br />Department of the Army US Army Corps of Engineers Permit, San Francisco Bay Regional Water Quality <br />Board -Conditional 401 Water Quality Certification, State of California Department of Fish and Wildlife -Final <br />Lake of Streambed Alteration Agreement, State of California Department of Transportation -Encroachment <br />Permit. <br />This project does not require a National Pollutant Discharge Elimination System (NPDES) General Permit <br />for storm water discharges associated with construction and land disturbance activities pursuant to <br />Attachment A.2 of Order No. R2-2015-0049, NPDES Permit No. CAS612008, which exempts projects to <br />update existing lines and facilities. However, the proposed construction will employ storm water <br />pollution prevention best methods and practices. <br />PUBLIC NOTICE <br />Public Notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />Council may choose not to award the project; and direct staff to reevaluate project scope, design, <br />schedule, cost and financing options and re -bid the project at a later time. This alternative is available and <br />made with the City's reserved right in accordance with the Project Contract Bid Document under Section <br />00200-1.14.A.
