ENVIRONMENTAL REVIEW The proposed contract award is consistent with a previously -approved mitigated negative declaration. On April 25, 2016 City Council adopted Resolution No. 15488 adopting the U.S. Highway 101 Pedestrian Undercrossing and Bair Island Road Storm Drain Pump Station Project initial study and mitigated negative declaration and a mitigation monitoring and reporting plan all in accordance with the requirements of the California Environmental Quality Act, and approving the U.S. Highway 101 Pedestrian Undercrossing Project Design. This project will also adhere to requirements of all applicable permits, including but not limited to: Department of the Army US Army Corps of Engineers Permit, San Francisco Bay Regional Water Quality Board -Conditional 401 Water Quality Certification, State of California Department of Fish and Wildlife -Final Lake of Streambed Alteration Agreement, State of California Department of Transportation -Encroachment Permit. This project does not require a National Pollutant Discharge Elimination System (NPDES) General Permit for storm water discharges associated with construction and land disturbance activities pursuant to Attachment A.2 of Order No. R2-2015-0049, NPDES Permit No. CAS612008, which exempts projects to update existing lines and facilities. However, the proposed construction will employ storm water pollution prevention best methods and practices. PUBLIC NOTICE Public Notification was achieved by posting the agenda, with the agenda items being listed, at least 72 hours prior to the meeting. ALTERNATIVES Council may choose not to award the project; and direct staff to reevaluate project scope, design, schedule, cost and financing options and re -bid the project at a later time. This alternative is available and made with the City's reserved right in accordance with the Project Contract Bid Document under Section 00200-1.14.A. However, bidding the project at a later time may have a negative impact to project schedule and costs.
