The summary vacation and <br />easement dedication is required to adjust the existing easement to be located over the new path location <br />to continue to allow for public access to the pedestrian and bicycle path. <br />ANALYSIS <br />The Landscape Maintenance Agreement identifies the City owned easements within the subject property <br />wherein all improvements are to be maintained. <br />In order to comply with the Municipal Regional Permit, the City must verify that all stormwater treatment <br />devices to be installed within the City are adequately maintained. While maintenance is the responsibility <br />of the property owner, the City must complete inspections of every stormwater treatment device in the <br />City at least once every five years in order to verify that proper maintenance is occurring. The Stormwater <br />Treatment Measures Maintenance Agreement describes the maintenance and reporting responsibilities <br />of the property owner, and allows City staff to access the property in order to inspect the treatment <br />measures. <br />The City's interest in a bicycle and pedestrian easement is as shown on the Subdivision Map "Parcel Map <br />No. 2011-02" recorded in Book 79 of Parcel Maps, at Pages 90-92. This was the map that created the <br />development parcel, and the easement coincided with an unpaved path that existed on the parcel. In <br />order to relocate the path, the City will need to vacate its interest in the existing easement and accept a <br />dedication for the new easement. <br />The Streets and Highway Code Section 8330 authorizes the vacation of public services easements by a <br />resolution of City Council. Summary vacation is permitted here under Section 8333 because of the <br />following: the easement has been superseded by relocation, or determined to be excess by the easement <br />holder, and there are no other public facilities located within the easement. <br />FISCAL IMPACT <br />There is no fiscal impact to the City as a result of this action. <br />ENVIRONMENTAL REVIEW <br />This activity is exempt under the California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15304 (Minor Alterations to Land), because the landscaping and stormwater <br />improvements and easement relocation involve limited changes to the approved plans to accommodate <br />a pump station project.
