<br />(f) <br /> <br />The total GBFA in Zones 1 through 4 must not exceed 1,000,000 square <br /> <br />feet for office space; and 50,000 square feet for the special purpose accessory structures <br /> <br />referred to in subsection (c). <br /> <br />(g) <br /> <br />During the term of this Agreement, City may apply new Development <br /> <br />Regulations to the development of the Project which are not in conflict with the <br /> <br />Existing Development Regulations, the Existing Approvals, or this Agreement. A <br /> <br />new Development Regulation is in conflict with this Agreement if it alters any <br /> <br />Exaction except as expressly permitted under this Agreement, or if it alters any of the <br /> <br />Existing Approvals, including without limitation, any of the following: <br /> <br />(i) <br /> <br />Land uses; <br /> <br /> <br />(ii) <br /> <br />Density or intensity of land uses; <br /> <br />(iii) <br /> <br />GBFA; <br /> <br />(iv) <br /> <br />The height, size or location of buildings; or <br /> <br />(v) <br /> <br />T~e modifications permitted under subsection (e). <br /> <br />5. <br /> <br />Project Timing <br /> <br />(a) <br /> <br />Except as provided in Section 3, Flatirons may develop the Zones in the <br /> <br />order and at the times Flatirons, in its sole discretion, deems appropriate based on <br /> <br />Flatirons' analysis of those factors determining, in Flatirons' judgment, the <br /> <br />appropriate pace and timing of the development of the Project. <br /> <br />(b) <br /> <br />The adoption or modification of any Development Regulation or <br /> <br />B';1ilding Regulation by City, whether by initiative or otherwise, limiting or <br /> <br />prescribing the pace or timing of development or construction within City is in <br /> <br />-12- <br /> <br />DV AGR0'3.rxJC <br />August 26, 1996 <br />
