<br />without payment of further Facilities Fees for that square footage, in an amount <br /> <br />equal to the difference between the Cumulative Total GBFA in Column A for which <br /> <br />Facilities Fees have been paid and the Cumulative Total GBFA included in building <br /> <br />permits that have been issued and for which any Advance Payments (as hereinafter <br /> <br />defined) have been made on the date of the Cumulative Total GBFA Payment. For <br /> <br />example, if on January 1, 1997, building permits had been issued and Advance <br /> <br />Payments (as hereinafter defined) had been made under subsection (c) which <br /> <br />together included a Cumulative Total GBFA of 325,000 square feet of GBFA, then <br /> <br />the Facilities Fee payable on January 1, 1997 on the 50,OOO-square-foot difference <br /> <br />between the Cumulative Total GBFA in Column A of the table and the Cumulative <br /> <br />Cum. Total GBFA in Col. A - (Cum. Total GBFA + Sq. Ft. Allowed By Adv. Paymt ) <br />x Agreed Chg. Rt. = <br />2,000 <br />Cum.. Total GBFA Paymt <br /> <br /> <br />Total GBFA for which building permits had been issued and Advance Payments <br /> <br />made would be: <br /> <br />( 375, 000 - 325, 000) x $12 350 = $308 750 <br />2, 000 ' , <br /> <br />and Flatirons would be entitled to construct an additional 50,000 square feet of GBFA <br /> <br />without payment of further Facilities Fees for that square footage upon issuance of <br /> <br />the necessary building permits. <br /> <br />(c) <br /> <br />Flatirons may pay Facilities Fees before payment would be required <br /> <br />under subsections (a) or (b) ("Advance Payment").
