<br />(h) <br /> <br />City may assess Engineering Department plan check and construction <br /> <br />inspection deposits only on the construction of Facilities that will be owned or <br /> <br />maintained, or both, by City or District. <br /> <br />10. <br /> <br />Design Of The Facilities. <br /> <br />All Facilities, including the Flatirons Facilities, must be designed and <br /> <br />constructed in accordance with City standards for public improvements and in <br /> <br />accordance with plans and specifications approved by City's Engineering <br /> <br />Department. <br /> <br />11. <br /> <br />On-Site Privately Owned Improvements <br /> <br />Flatirons shall construct at Flatirons' sole cost all on-site i~provements, <br /> <br /> <br />including but not limited to, on-site parking lots, roadways, utility improvements, <br /> <br />and similar improvements, which are not offered for dedication to City for <br /> <br />ownership, operation or maintenance (the "Private On-Site Improvements"). <br /> <br />No <br /> <br />performance bonds, labor and materials bonds, or insurance may be required for the <br /> <br />Private On-Site Improvements. Flatirons shall construct the Private On-Site <br /> <br />Improvements according to the standards contained in the Building Regulations in <br /> <br />effect at the time of the issuance of the building permit arid applied by the <br /> <br />Community Development Department of City to private improvements that are <br /> <br />not the subject of a planned development permit. Neither City nor City through <br /> <br />District may apply to the Private On-Site Improvements either the Engineering <br /> <br />Standards adopted by Redwood City Council Resolution No. 11,662 on December 16, <br /> <br />1991, or any similar ordinance, resolution, code, rule, regulation, or official policy <br /> <br />-28- <br /> <br />DV AGR0'3.rxJC <br />August 26, 1996 <br />
