<br />which establishes separate or additional standards for private improvements that <br /> <br />are the subject of a planned development permit. <br /> <br />12. <br /> <br />Traffic Assessment District. <br /> <br />Flatirons shall participate in an assessment district pursuant to the <br /> <br />Improvement Act of 1911 (Sts. & Hwys. Code §§5000, et seq.); the Improvement Act <br />of 1913 (Sts. & Hwys. Code §§10000 et seq.); the Benefit Assessment Act of 1982 <br /> <br />(Gov't. Code §§54703, et seq.); or other fair share funding mechanisms which <br /> <br />include all existing and future Redwood Shores non-residential developments on <br /> <br />an equitable and benefit basis for the construction of off-site traffic mitigation <br /> <br />improvements. In pursuance of the foregoing, Flatirons hereby waives objection or <br /> <br /> <br />protest to the formation or establishment of any such district or mechanism; <br /> <br />provided'that Flatirons hereby reserves its right to protest the amount of any such <br /> <br />assessment, fee or charge, the formula therefor or the extent or design of the <br /> <br />improvements to be constructed thereby; provided, further, that the Property shall <br /> <br />not be included in any such assessment district formed to construct improvements <br /> <br />to streets located easterly of the easterly boundary of the right of way of Twin <br /> <br />Dolphin Drive projected northerly across Marine Parkway and southerly across <br /> <br />Redwood Shores Parkway. The area in which improvements cannot be funded <br /> <br />pursuant to any such assessment district or other fair share funding mechanism <br /> <br />under this Section 12 is located generally east of the shaded area depicted on Exhibit <br /> <br />F.
