<br />13. <br /> <br />Shuttle Service. <br /> <br />Flatirons or its tenants shall provide a shuttle service to transport employees <br /> <br />who work on the Property to and from the nearest CalTrain station. This service <br /> <br />must begin upon the occupancy of 50% of the leasable space in the Project and must <br /> <br />continue throughout the life of the Project. Flatirons or its tenants may discontinue <br /> <br />this service with the approval of City. Flatirons or its tenants shall promote the <br /> <br />shuttle and attempt to meet passenger demand. In lieu of the requirement set forth <br /> <br />in this Section 13 , Flatirons or its tenants may, subject to City approval, participate <br /> <br />in the existing shuttle service that serves other commercial properties in Redwood <br /> <br />Shores. Nothing in this Section 13 precludes City from requiring the participation <br /> <br />14. <br /> <br />Water; Sewer. <br /> <br /> <br />of Flatirons or its tenants in the County Transportation Management Program. <br /> <br />(a) <br /> <br />City and City through District acknowledge and agree that: <br /> <br />(i) <br /> <br />Redwood Shores Properties ("RSP") as the successor in interest <br /> <br />to Mobil Oil Estates (Redwood) Limited ("Mobil") under the <br /> <br />agreement relating to sanitary sewerage treatment capacity by <br /> <br />and between City and Mobil dated May 1, 1978 ("Capacity Rights <br /> <br />Agreement") has assigned to Flatirons 88,500 gallons per day <br /> <br />(gpd) of the non-grant-eligible sewerage treatment capacity <br /> <br />owned by RSP under the Capacity Rights Agreement; and <br /> <br />(ii) <br /> <br />The 88,500 gpd of non-grant-eligible sewerage treatment capacity <br /> <br />assigned to Flatirons by RSP is sufficient to construct 885,000 <br /> <br />-30- <br /> <br />DV AGR0'3.rxJC <br />August 26, 1996 <br />
