<br />DV AGR0'3.rxJC <br />August 26, 1996 <br /> <br />(iii) <br /> <br />(iv) <br /> <br />square feet of GBF A for office use and 50,000 square feet of GBF A <br /> <br />for special purpose accessory structures on the Property, and <br /> <br />throughout the term of this Agreement, irrespective of present <br /> <br />or future demands within City for sewage treatment capacity, <br /> <br />neither City nor City through District may require Flatirons to <br /> <br />provide, furÌùsh, arrange for, purchase, lease or otherwise <br /> <br />acquire rights to any additional sanitary sewerage treatment <br /> <br />capacity as a condition of or prerequisite to building up to 885,000 <br /> <br />square feet of GBFA for office use. <br /> <br />100,000 gpd of sewerage treatment is sufficient to construct <br /> <br />1,000,000 square feet of GBF A for office use and 50,000 square feet <br /> <br /> <br />of GBFA for special purpose accessory structures on the Property, <br /> <br />and throughout the term of this Agreement, irrespective of <br /> <br />present or future demands within City for sewage treatment <br /> <br />capacity, neither City nor City through District may require <br /> <br />Flatirons to provide, furnish, arrange for, purchase, lease or <br /> <br />otherwise acquire rights to any additional sanitary sewerage <br /> <br />treatment capacity as a condition of or prerequisite to building <br /> <br />up tp 1,000,000 square feet of GBF A for office use. <br /> <br />City shall sell additional sanitary sewerage treatment capacity to <br /> <br />Flatirons up to 25,000 gpd, as needed, for the same price City pays <br /> <br />for that capacity from the South Bayside System Authority. <br /> <br />Additional sanitary sewerage treatment capacity must be <br /> <br />-31- <br />
