6.K. - Page 45 of 190 <br />13.5 Removal from Eligible List <br />The name of any person on an eligible list may be removed by the Personnel <br />Officer if the eligible person requests in writing that his/her name be removed, <br />if he/she fails to respond to a written offer of employment within five (5) days <br />or receipt of the mailing of a notice, if a subsequent report of a character <br />investigation is unsatisfactory, or he/she has been rejected for appointment <br />three (3) times by the Fire Chief. <br />13.6 Time Off for Examination <br />Promotional examinations scheduled by the City during an employee's regular <br />working hours may be taken without any loss in compensation. <br />SECTION 14 - DISCIPLINE <br />14.1 Right of Discipline <br />The City shall have the right to discipline any employee for just cause. <br />An employee will have thirty (30) days within which to file a written response <br />to any adverse comment entered into his or her personnel. file which does not <br />constitute a punitive action as described ageaebelow. The written response <br />will be attached to the adverse comment. <br />14.2.2 Appeal Procedure for Punitive Action Other Than <br />Sus ertsion Reduction ire Pa Dertaotioe r Disch e <br />The following informal procedure will to employees (as defined by <br />Government Code Section 3251) as to letters of reprimand, disciplinary <br />transfersi or non -voluntary, no€ -disciplinary transfers resulting in a loss of <br />compensation e.g., non -disciplinary transfer out of premium pay assignment). <br />At no time will an employee be required to waive his/her legally provided <br />appeal rights. <br />A.
