6.K. - Page 48 of 190 <br />............... . <br />Reduction Or DischaLge <br />This pre -disciplinary procedure applies to for -cause employees who <br />are subjected to disciglinary suspension, demotion reduction in <br />pay, or, discharcre. <br />The followingcategoriesof persons can be terminated at -will and <br />have no rights to any of the pre or post-disciplinaty processespost-discipline or <br />procedures in this Policy (1) gart-time employees, (2) temporary, <br />provisional or seasonal employees. (3) probationaty employees, (4 <br />any_person who serves pursuant to a contract, and 5) any person <br />who is designated "at -will" in any City policy.document <br />acknowledgement, resolution or ordinance. Only for -cause <br />employees have the right to the Skglly Conference and appeal <br />processes outlined in this Section. <br />contains the following: <br />A. The level of discipline intended to be imposed; <br />B. The specific char es upon which the intended discipline is <br />based; <br />C. A summa of the facts upon which the char es are based; <br />D. A copy of all written materials reports, or documents upon <br />which the intended discipline is based; <br />E. Notice of the em to ee's right to respond to the Fire Chief <br />regarding the charges within seven i calendar days from the <br />date of the ]Notice either by requesting an informal <br />conference the " 5kell Conference' orb rovidin a written <br />response, or both; <br />F. Notice of the employee's right to have a representative of his <br />or her choice at the Skelly Conference should he or she <br />choose to respond orally; and <br />G. Notice that the failure to respond at the time specified shall <br />constitute a waiver of the right to respond prior to the <br />imposition of discipline. <br />14.2,3.2 Ern llo_yee's Response and the Skellw <br />Conference <br />A. If the ern to ee re uests a Skelly Conference to respond orally <br />to the charge(s), the conference will be scheduled within.a <br />reasonable time after the date of the Notice, The Skeliv <br />Conference will be an informal meeting mite the Fire Chief, at <br />which the employee has an opportunity to rebut the chargees <br />against him or her and present any mitigating circumstances. <br />37 <br />291 <br />
