<br />ORIGINAL <br /> <br />AMENDMENT NO.2 <br />TO EXTEND AND AMEND THE AGREEMENT FOR THE 2005-2006 COST SHARED <br />SIDEWALK REPAIR PROJECT BETWEEN THE <br />CITY OF REDWOOD CITY, CALIFORNIA <br />AND <br />JJR CONSTRUCTION, INC. <br /> <br /> <br />This agreement ("Amendment No.2") is made and entered into on this ~ day of J:JJ Y <br />2008, ("Effective Date") by and between the City of Redwood City, California, a chart <br />California municipal corporation, with its principal place of business located at 1017 <br />Middlefield Road, Redwood City, California 94063 ("City") and JJR Construction, Inc., a <br />California corporation with its principal place of business located at 1120 Ninth Avenue, <br />San Mateo, CA 94402 ("Contractor"). Contractor and City may be referred to herein <br />individually as a "Party" or collectively as the "Parties" or the "Parties to this Amendment <br />NO.2." <br /> <br />RECITALS <br /> <br />A. The Parties previously entered into an agreement entitled "Agreement for the City of <br />Redwood City 2005-2006 Cost Shared Sidewalk Repair Project", dated July 12, <br />2006 (the "Original Agreement"); and <br /> <br />B. The Original Agreement was previously amended by Amendment No.1, dated June <br />8,2007, and is again amended by this Amendment NO.2. The Original Agreement <br />and all previous amendments are collectively referred to herein as the "Original <br />Agreement as Amended"; and <br /> <br />C. The Parties entered into the Original Agreement as Amended for the purpose of <br />having Contractor provide repair services for damaged sidewalk, driveway <br />approach, and curb and gutter, and construction of wheel chair ramps and tree <br />grates as needed and associated tree mitigation, and street paving. The Parties <br />now wish to extend the Original Agreement as Amended to provide services <br />pursuant to an updated fee schedule attached hereto as Exhibit "A." <br /> <br />In consideration of the above Recitals and the following mutual covenants and obligations, <br />the Parties agree as follows: <br /> <br />AGREEMENT PROVISIONS <br /> <br />1. Contractor will provide those services described in the Original Agreement as <br />Amended according to the fee schedule set forth in Exhibit "A," attached hereto and <br />incorporated herein by this reference. With this Amendment, the total aggregate <br />Agreement amount shall not exceed One Million Four Hundred Four Thousand <br />Eighty-Three dollars ($1,404,083). <br /> <br />Atty/Agr/2008/Amendments/ JJR Construction, Inc. <br />060208 1 <br />
