<br />G. <br /> <br />On June 2, 1998, the City approved an amendment to Planned <br /> <br />Development Permit PD10307-5 to authorize the changes in the location of certain <br /> <br />buildings shown in the Master Plan as desired by Flatirons. <br /> <br />H. <br /> <br />On the date of recordation of this Second Amendment, the Association <br /> <br />is conveying fee title to Lot A and Lot B to Flatirons, portions of which parcels will <br /> <br />become part of the Property; the Parcel Map is being filed for record in the official <br /> <br />records of San Mateo County; and Flatirons is conveying fee title to Common Area <br /> <br />Parcel A and Common Area Parcel B to the Association, which parcels will become <br /> <br />two of the five New Common Area Lots and will no longer be part of the Property. <br /> <br />I. <br /> <br />As a result of the foregoing, the Property will consist of the eight (8) lots <br /> <br /> <br />described in Exhibit J attached hereto and incorporated herein by this reference. <br /> <br />J. <br /> <br />Flatirons, the City, and Electronic Arts also wish to make other <br /> <br />conforming changes to the following exhibits to the Development Agreement;: <br /> <br />Exhibit C (Description of Zones); Exhibit H (Master Plan); and Exhibit I (Planned <br /> <br />Development Permit No. PD10307-5). <br /> <br />K. <br /> <br />Flatirons, the City, and Electronic Arts also wish to amend the <br /> <br />Development Agreement to acknowledge that on June 10, 1996, the City and <br /> <br />Redwood Shores Properties, a California joint venture general partnership ("RSP"), <br /> <br />entered into the First Amendment to Agreement, Sanitary Sewerage Capacity <br /> <br />Rights, (the" Amended Capacity Rights Agreement") relating to the remaining <br /> <br />non-grant-eligible sanitary sewerage treatment capacity rights ("Treatment Capacity <br /> <br />-4- <br /> <br />2DAAMND8.DOC <br />
