The employee on leave shall be returned to his/her original position or if that position is not <br />in existence, to an equivalent position within his/her classification. <br />A parental leave, absent physical disability, is granted without pay for the duration of leave. <br />The employee may elect to continue medical and dental insurance coverage for up to one (1) <br />year during this leave at his/her own expense. <br />A worker may incorporate a portion of his/her parental leave intoprovisionsof the Family <br />and Medical Leave Act. <br />j. Leave for Preenancv Disability - Employees who are working are entitled to use personal <br />illness and injury leave for disabilities caused or contributed to by pregnancy, miscarriage, <br />childbirth, and recovery therefrom on the same terms and conditions governing leaves of <br />absence for other illness or medical disability. Such leave shall not be used for child care, <br />child rearing, or preparation for childbearing, but shall be limited to those disabilities as set <br />forth above. The length of such disability leave, including the date on which the leave shall <br />commence and the date on which the duties are to be resumed, shall be determined by the <br />employee and the employee's physician; however, the Human Resources Director may <br />require a verification of the extent of disability through a physical examination of the <br />employee by a physician appointed by the City at the City's expense. <br />Employees are entitled to leave without pay or other benefits for disabilities because of <br />pregnancy, miscarriage, childbirth, or recovery therefrom when sick leave has been <br />exhausted. The date on which the employee shall resume duties shall be determined by the <br />employee on leave and the employee's physician; however, the Human Resources Director <br />may require a verification of the extent of disability through a physical examination of the <br />employee by a physician appointed by the City. <br />The employee on leave shall be returned to her original position or if that position is not in <br />existence to an equivalent position within her classification. <br />k. Familv and Medical Leave - Family medical leave will be offered to employees as per City <br />policy. <br />1. Court Anoearance Leave - Leave for court appearance shall be granted by the City for court <br />appearance on behalf of the City with no loss of salary. <br />in. Jury Duty - Any employee whose name shall be selected from the list of trial jurors to serve <br />as a juror in a civil or criminal action pending in a Superior, Municipal, or Justice Court of <br />the State of California, or any Federal court convening in the State of California, or any <br />employee required to report for the selection of a jury in any of these courts shall receive pay <br />for the time such service requires his absence from work; provided, however, that the City <br />may require proof of the time such service was required and any moneys received from jury <br />service shall be deducted from the pay; provided, further, that the employee shall report to <br />work whenever a, reasonable portion of the workday or shift remains for completion.
