<br />DES:djk r¡1/24/97 <br /> <br />(027a/70) <br /> <br />including death, and property damage occasioned by the operations <br /> <br />of Owner or Owner's contractors or subcontractors under the terms <br /> <br />of <br /> <br />this <br /> <br />Agreement, <br /> <br />and <br /> <br />shall <br /> <br />be <br /> <br />in <br /> <br />the <br /> <br />minimum <br /> <br />limits <br /> <br />of <br /> <br />$1,000,000 for personal injuries to, or death of, anyone person, <br /> <br />$1,000,000 <br /> <br />for personal injury or death arising out of anyone <br /> <br />occurrence, <br /> <br />and <br /> <br />property <br /> <br />damage <br /> <br />limits <br /> <br />of <br /> <br />not <br /> <br />less <br /> <br />than <br /> <br />$1,000,000 <br /> <br />arising <br /> <br />out <br /> <br />of <br /> <br />any <br /> <br />one <br /> <br />occurrence. <br /> <br />The <br /> <br />policies <br /> <br />mentioned <br /> <br />herein <br /> <br />shall <br /> <br />contain <br /> <br />a <br /> <br />provision <br /> <br />that <br /> <br />City <br /> <br />shall <br /> <br />receive an unconditional notice in writing thirty <br /> <br />(30) <br /> <br />days in <br /> <br />advance <br /> <br />of <br /> <br />an <br /> <br />insurer's <br /> <br />intention <br /> <br />to <br /> <br />cancel <br /> <br />or <br /> <br />materially <br /> <br />to <br /> <br />change <br /> <br />the <br /> <br />terms <br /> <br />of <br /> <br />said <br /> <br />policies <br /> <br />given <br /> <br />to <br /> <br />City. <br /> <br />If <br /> <br />such <br /> <br />insurance covers Owner, other entity, or person(s) in addition to <br /> <br />including, <br /> <br />but <br /> <br />not <br /> <br />limited <br /> <br />to, <br /> <br />the <br /> <br />provisions <br /> <br />of <br /> <br />Paragraph <br /> <br />1 <br /> <br /> <br />the City of Redwood City, such policy shall contain the standard <br /> <br />form of cross liability or severability of interest endorsement. <br /> <br />Such <br /> <br />insurance <br /> <br />shall <br /> <br />also <br /> <br />specifically <br /> <br />insure <br /> <br />any <br /> <br />contractual <br /> <br />liabili ty assumed by Owner under the <br /> <br />terms <br /> <br />of this Agreement, <br /> <br />above. <br /> <br />5. <br /> <br />MONUMENTS. <br /> <br />All <br /> <br />pipes <br /> <br />and <br /> <br />monuments <br /> <br />shown <br /> <br />on <br /> <br />the <br /> <br />subdivision map <br /> <br />hereinafter <br /> <br />referenced which <br /> <br />are <br /> <br />destroyed <br /> <br />or <br /> <br />displaced <br /> <br />during <br /> <br />construction <br /> <br />operations <br /> <br />shall <br /> <br />be <br /> <br />replaced by <br /> <br />Owner at the time of the final inspection of the Improvements, if <br /> <br />any, hereunder by City. <br /> <br />6. <br /> <br />OWNERSHIP OF IMPROVEMENTS. <br /> <br />It is agreed that title and <br /> <br />ownership of all Improvements constructed for the benefit of City <br /> <br />hereunder by Owner shall vest absolutely in City upon completion <br /> <br />and acceptance of such Improvements by City. <br /> <br />5 <br />
