<br />applicable to Consultant's vehicle

<br />
<br />The CONTRACTOR will provide proof of the required insurance coverage and will
<br />identify RCSD as an additionally insured. In lieu of providing anyone of the above
<br />
<br />required insurance certificates and endorsements, CONTRACTOR may provide proof of
<br />
<br />CONTRACTOR's self-insured status.
<br />
<br />6. EQUAL EMPLOYMENT OPPORTUNITY

<br />In connection with the performance of this Agreement, the CONTRACTOR shall not
<br />
<br />discriminate against any employee or applicant for employment because of race,
<br />
<br />religion, color, sex, sexual orientation, physical disability, national origin, or marital
<br />
<br />status, in violation of state or federal law.

<br />7. MUTUAL HOLD HARMLESS
<br />
<br />RCSD hereby agrees to indemnify, protect, defend, and hold harmless CONTRACTOR,
<br />
<br />its Council, boards, commissioners, officers, employees and agents, from and against
<br />
<br />any and all claims, suits, actions, liability, loss damage, expense, cost (including, without
<br />
<br />limitation, costs and fees of litigation) of every nature, kind or description, which may be
<br />
<br />brought against, or suffered or sustained by, CONTRACTOR, its Council, boards,
<br />
<br />commissions, officers, employees, or agents, arising out of the performance of the work
<br />described herein, to the extent caused in whole or in part by any negligent, reckless, or
<br />
<br />wrongful acts, errors, or omissions of RCSD, its officers, agents and employees, or
<br />
<br />anyone directly or indirectly employed by any of them or anyone whose acts any of them
<br />
<br />may be liable, except where caused by the active negligence, sole negligence, or willful
<br />
<br />misconduct of CONTRACTOR.
