3. Property Usage The use of the above - described property by <br />Permittee shall be limited solely to underground conduits with communication <br />lines and related uses as set forth in the permit. <br />4. Improvement Compliance The said underground conduits with <br />communication lines and related uses shall be maintained, repaired, and /or <br />reconstructed in conformance with all applicable laws, statutes, ordinances, <br />rules, and regulations, and said maintenance, repair, and /or reconstruction shall <br />be performed to the satisfaction of the City of Redwood City. <br />5. Cost of Maintenance The maintenance, repair, and /or reconstruction <br />of said underground conduits with communication lines and related uses shall be <br />at the sole cost and expense of Permittee and Permittee shall maintain said <br />underground conduits with communication lines in a state of good repair and in a <br />neat and attractive condition, likewise, at its own cost and expense. <br />6. Manner of Maintenance Permittee shall carefully maintain, repair, <br />and /or reconstruct said underground conduits with communication lines and <br />related uses in such manner as not to damage, interfere with, or obstruct the use <br />of City granted or dedicated right -of -way. <br />If Permittee so damages, interferes with, or obstructs the use of City <br />granted or dedicated right -of -way not included in this permit, Permittee shall bear <br />all costs and expense thereby incurred by said City, agents, employees, <br />contractors or subcontractors, and Permittee shall reimburse said City, agents, <br />employees, contractors or subcontractors for such cost and expense of City <br />Agmt -317 2 <br />f:\sh\sh /Redwood \Council <br />FXS:rg <br />12/16/99 <br />
