upon request so to do by City, remove said underground conduits with <br />communication lines described in paragraph 2 hereof. <br />9. Release Permittee shall be responsible and liable for all damages to <br />persons or property, including the injury or death of persons, due directly or <br />indirectly to Permittee's construction and /or maintenance of the said <br />underground conduits with communication lines and the use permitted <br />hereunder, and shall defend, indemnify, and shall hold the City of Redwood City, <br />its Council, officers, boards, commissions, Councilmembers, agents, and <br />employees harmless from all suits, actions, damages, or claims to which said <br />City may be subjected and alleged to have been caused by reason of said <br />construction and /or maintenance of said underground conduits with <br />communication lines or encroachment or use thereof permitted hereunder. <br />10. Insurance Permittee shall secure, carry, and maintain at all times in <br />form and amount approved by the City Attorney during the period covered by this <br />revocable permit, at Permittee's sole cost and expense, public liability and <br />property damage insurance, which insurance shall be in the following minimum <br />amounts: <br />(a) $1,000,000 for injury or death of any one person and <br />$1,000,000 for any one occurrence; <br />(b) Property damage insurance in the amount of <br />$1,000,000 for any one occurrence. <br />Agmt -317 4 , <br />fAshlsh/RedwoodlCound1 <br />FXS:rg <br />12116199 <br />
