In consideration of the foregoing findings and determinations, this <br />Council hereby orders, and declares as follows: <br /> <br /> (a) The City Manager's and Engineer's Reports above-described are <br />hereby approved, subject to such amendment or modification thereto as may <br />occur by reason of the election and the protest hearing hereinafter ordered. <br /> <br /> (b) The formula for the annual assessment levies heretofore approved <br />pursuant to the above-described Resolution No. 9859 is hereby modified as set <br />forth in the above-mentioned Manager's and Engineer's Reports, and said <br />modified formula is hereby approved. <br /> <br /> (c) The formation of the District, having been established prior to the <br />enactment of Proposition 218, is hereby ratified and shall continue as an existing <br />maintenance assessment district under the Ordinance. <br /> <br /> (d) A property owners election is hereby called upon the question of <br />approval of the levy of assessments for fiscal year July 1, 1999 - June 30, 2000, <br />and continuing thereafter, subject to annual adjustments in accordance with the <br />formula heretofore approved and without further property owners election; ballots <br />for which election shall be mailed or submitted to the City Clerk on or before the <br />time and date of the public hearing upon the proposed assessments hereinafter <br />set forth. <br /> <br /> (e) The Notice of Proposed Assessment and Property Owner Ballot to be <br />mailed to the owners of property proposed to be assessed shall be in the form of <br /> <br /> Reso-672 5 <br /> F:/sh/shRC/Council 13645 <br /> 05/17/99R, 06/03/99R <br /> FXS:rg <br /> <br /> <br />
