The Union can provide
SBWMA information to compute the appropriate wages and benefits under this formula. We do not
think it will come to this, however, so long as the new contractor is required to adopt the wages and
benefits in the pre-existing labor contract.

As lVlr. Furgas stated at yesterday's meeting, the UniOD also proposes that the RFP require bidding
contractors to adopt a "Card Check" program procedure in the event the new contractor is faced
with competing demands by different unions for recognition as the representative of its employees.
Again" this is a highly unlikely situation. The bargaining relationship between Local 350 and the
current contractor is stable, and the proposed employee retention program win necessarily carry
over that stability to a successor contractor. In the unlikely situation where a question of employee
representation arises, however. the card check procedure provides a peaceful and ex.peditious was of
resolving the recognition issue, without picketing, striking or any disruption of service.

If any of the City Council members has questions, all are invited to communicate with Local 350.
We are aIlXious to make the .' prQ.CeS"S work.

Respectfully yo; ~

~

A 11 City Council Member
Edward Everett - City Manager
Brian Panty - Director of Finance

RMJah
