Contractor shall offer employment to all displa.ced workers who have been <br />employed by the current Contractor foI' a least one lnmdred. n:wnty (120) calendar days prior to <br /> <br />this eA.-piration of1he current agreement with JP A provided that Contractor shall not be required <br /> <br />to create additional positions that Contractor does not need. Contractor is prohibited from <br /> <br />discharging any displaced worker for a least ninety (90) days after the Collection Start-up Date <br /> <br />~cept for cause. Contractor shall submit worker hiring status reports to JP A on the last working <br />day of the first and second quarters of the year following the Contractor's assumption of the <br /> <br />work cov-e.rOO by the Franchise Agreement. <br /> <br />The following COIlditions are applicable to the fmegoing employee retention <br /> <br />requirements: <br /> <br />1. The Contractor's obligation under this provision shall be applicable only to non~ <br />supervisory and non-management em.ployees. <br /> <br />2.
