Labor Peace <br /> <br />The vulnerability of the proposed Franchise Agreement to labor disputes dictates that this <br /> <br />subject be addressed in all responses to the RFP. Proposers are therefore required to include in <br />their proposals a full discussion of how they will assure that no labor dispute or unrest that may <br />. <br /> <br />affect the continuity of their services will occur during the term of the Franchise Agreement <br /> <br />IV. Card Check <br /> <br />In the event a question of employee representation arises during the term of the Franchise <br /> <br />Agreement,. such question is to be resolved by a card oheck ngreement, upon the request of one <br /> <br />or more of the contesting union labor organizations. For the purposes oftbis Rule. the following <br /> <br />shall apply: <br /> <br />1. ~Card Check Agreement" means a written agreement betw'een the Contractor and <br /> <br />a labor orgaxll7.:lltion providing for a procedure to determine employee preference on the subject <br /> <br />of whether to be represented by a labor organization fur collective bargaining~ and if so, by <br /> <br />which labor or~1'I1'7Btion. <br /> <br />2. The preference of the employees in this respect sb.all be detem:rined by a card <br />check procedure (ve.rifying employee signatures by checking againSt the relevant employer <br />payroll) conducted by a neutral third party :in lieu of a formal election. <br /> <br />3. The Card Check Agreement shall include provisions allowing the labor <br /> <br />organization(s) involved reasonable access to the Contractor's premises for purposes of <br /> <br />Page 3 of4 <br />
