The immediate supervisor <br />shall hold discussions and attempt to resolve the matter within ten (10) <br />days after the presentation of the grievance. It is the intent of this <br />informal meeting that at least one personal conference be held bet\\leen <br />the aggrieved employee and the immediate supervisor. <br /> <br />15.3.1.2 Any unit member who believes he/she bas a grievance which is an <br />objection or challenge to any punitive disciplinary action shall present <br />the grievance orally to the Captain within ten (10) days after the <br />grievant knew, or reasonably should have known, of the circumstances <br />which form the basis for the grievance. Failure to do so will render the <br />grievance null and void. The Captain shall hold discussions and <br />attempt to resolve the matter within ten (I O) days after the presentation <br />of the grievance. It is the intent of this informal meeting that at least <br />one personal conference be held between the aggrieved employee and <br />the Captain. <br /> <br />15.3.2 Level n - Formal Written Grievance <br /> <br />15.3.2.1 If the grievance is not settled during the informal conference and the <br />grievant wishes to press the matter, the grievant shall present the <br />grievance in writing on the appropriate form to the Chief of Police <br />within ten (10) days after the oral decision by the immediate <br />supervisor. The written information shall include: (a) A description <br />of the specific grounds of the grievance, including names, dates, and <br />places necessary for a complete understanding of the grievance; (b) A <br />listing of the provisions of this MOU which are alleged to have been <br />violated; (c) A listing of the reasons why the immediate supervisor's <br />proposed resolution of the problem is unacceptable; and (d) A listing <br />of specific actions requested of the City which will remedy the <br />grievance. <br /> <br />15.3.2.2 The Chief of Police shall communicate the decision to the grievant in <br />writing within ten (10) days after receiving the grievance. If the Chief <br />of Police does not respond within the time limits, the grievant may <br />appeal to the next level. <br /> <br />15.3.2.3 Within the above time limits either party may request a personal <br />conference. <br /> <br />15.3.2.4 Prior to determining the level of discipline to be taken on alleged <br />violations of City or Department rules and/or regulations, the Chief or <br />his designee will: <br /> <br />1. Ascertain if the represented employee wishes the Association to <br />intervene on their behalf prior to the decision being made by the <br />Chief as to level of discipline. <br /> <br />27 <br />
