<br />G. Return of unused funds. Public Allies Silicon Valley <br />shall, upon termination of any Ally in its employment before March <br />31, 2007 or upon termination of this Agreement before March 31, <br />2007, reimburse the Partner Organization within two (2) weeks of <br />the termination for the appropriate percentage of the Partner <br />Organization contribution to the Ally's stipend. <br /> <br />H. Worker's Compensation. Public Allies shall provide <br />Worker's Compensation insurance to the full extent required by law <br />and accepts full responsibility for the payment of premiums for <br />Worker's Compensation, Social Security and health insurance <br />benefits, as well as all income tax required by law for Allies who <br />are performing services in connection with the program. <br /> <br />I. Nondiscrimination. In carrying out its part of the <br />Program, Partner Organization shall not discriminate against any <br />Ally or Program applicant because of race, color, religion, sex, <br />national origin or disability. Partner Organization shall take <br />affirmative action to insure that applicants are treated during <br />the Program without regard to their race, color, religion, sex, <br />national origin, or disability and eliminate the effects of past <br />discrimination. Such action shall include, but not be limited to <br />the following: employment, upgrading, demotion, or transfer; <br />recruitment or recruitment advertising; layoff or termination; <br />alteration of rates of payor other forms of compensation; and <br />selection for the Program. Partner Organization shall post in <br />conspicuous places, available to Allies and applicants, notices <br />setting forth the provisions of this nondiscrimination clause. <br />Partner Organization shall state that all qualified applicants <br />will receive consideration for Ally Positions without regard to <br />race, color, religion, sex, national origin, or disability. <br /> <br />J. Nondisplacement. Partner Organization shall not <br />displace any employee or position, including partial displacement <br />such as through a reduction in hours, wages, or employment <br />benefits, as a result of the assistance available to the Partner <br />Organization through any Ally. No activity that enables Ally to <br />perform meaningful and constructive service in agencies, <br />institutions, and situations where the application of human talent <br />and dedication may help to meet human, educational, linguistic, <br />public safety, and environmental community needs shall infringe in <br />any manner on the promotional opportunity of an employed <br />individual. No Ally shall perform any service or duties, or <br />engage in activities, that would otherwise be performed by an <br />employee as part of the assigned duties of such employee. Any <br />Program activities shall not involve the performance of services <br />that would supplant the hiring of employed workers or would <br />otherwise be performed by an employee, including an employed <br />worker who recently resigned or was discharged, an employee who is <br /> <br />6 <br /> <br />----JiJZ.... ...'...."~ <br />
