<br />SECTION 4. Section 38.12 of the Code of the City of Redwood <br /> <br />City is hereby amended to read as follows: <br /> <br /> <br />"Section 38.12 Every application for a connection for <br /> <br /> <br />water service to serve property located in water service Areas 2 and <br /> <br /> <br />4 shall,in addition to all other fees, be accompanied by a <br /> <br />fee in the amount of Five Hundred Dollars ($500.00), which <br /> <br /> <br />fee shall be refundable to the person making the payment <br /> <br /> <br />(upon request therefor made within one year after the date <br /> <br />of annexation) if the property for which the connection is <br /> <br /> <br />applied for is annexed to the City within two years after <br /> <br /> <br />the installation of the water service connection. The fee <br /> <br /> <br />required by this section shall not be applicable to connections <br /> <br /> <br />serving property located in incorporated territory of another <br /> <br />ci ty. " <br /> <br /> <br />SECTION 5. Section 38.13 of the Code of the City of Redwood <br /> <br /> <br />City is hereby amended to read as follows: <br /> <br />"Section 38.13 (a) No water connection permit shall <br /> <br /> <br />be issued to serve any premises located within water service <br /> <br />Area 3 from water facilities located in another water service <br /> <br /> <br />area. <br /> <br />"(b) Notwithstanding the foregoing prohibition, and <br />upon application, the City Council may authorize the issuance <br />of a water connection permit to serve premises located in <br />one water service area from water facilities located in another <br />water service area when it finds the existence of exceptional <br />or extraordinary conditions affecting such premises. The <br />authorization shall be made by resolution and may be subject <br />to such terms, conditions and fees as the Council finds <br />necessary or appropriate." <br /> <br />-4- <br />
