(h) Emergency overhead facilities, which may be installed and maintained for a period not to exceed ten days without authority of the Council of the City of Redwood city in order to provide service in cases of emergency or unusual circumstances; provided, however, that upon application therefor, the Council of the City of Redwood City may grant by resolution special exceptions on such terms and for periods in excess of the aforementioned ten days, as the council may deem appropriate in cases of emergency or unusual circum- stances and without discrimination as to any person or utility, to permit the erection, construction, installation, maintenance, use and operation of poles and overhead wires and associated overhead structures. ( i) Facilities exempted from the p'rovisions of Article IV of Chapter II of the Code of t~~ City of Redwood City pursuant to section 11.46 of said Code. SECTION 8. From and after the time fixed by Section 5 of this ordinance, it shall be unlawful for any person, including utility companies, to erect, maintain or operate any pole, overhead wire or associated structure in any portion of any public street, alley or way within underground utility District No. 69-1. Violation of this section shall be a misdemeanor punishable as provided in Section 1.7 of the Code of the city of Redwood City. SECTION 9. The City Clerk shall give notice of the adoption of this ordinance as provided by Section 11.47 of the Code of the City of Redwood City and shall accompany said notice with a copy of this ordinance. SECTION 10. This ordinance shall be effective 30 days from the date of its adoption. * * * .. -5- T
