It is determined that the damage to the .public arising through loss of service and the necessity for furnishing individual antenna facilities is impractical and extremely difficult to ascertain. ,It is therefore determined that ~he grantee shall pay to the City in the event of such failure the cash sum of lwo Hundred Thousand Dollars ($200,000) , . as liquidated damages. The grantee's surety shall be responsible on its b~nd for such payment. The bonding requirements of this paragraph 5(b) may be reduced from tim~ to time during the installation of the CATV system in an amount proportionate to the installation work c?mpleted upon recommendation by the City Manager and approval by the City Council. (c) The grantee shall during the term of this franchise extend its service to all areas of the City, including sub- sequently annexed territory, in conjunction with the development of such areas. In those areas of the City developed subsequent to the granting of this franchise wherein the grantee's facilities must be located underground, the grantee shall install such facili- ties underground at his o\Yn cost either prior to, or concurrently w~th, other underground utility facilities and in every case, prior to the surfacing of the public rights of way. , (d) Notwithstanding the provisions of this Section 5, the grantee shall not be obligated to install cable television ser- vice in any portion of the. City where cable television service has been authorized by franchise granted by this City to another grantee. (e) Installation of underground facilities pursuant to the provisions of Article IV of Chapter 11 of the Code of the City of Redwood City shall be in accordance with such ~rovisions, shall be performed within the times provided for therein and shall be at the grantee's-expense. - 3 - T
