<br />REG. eK ::;/L.~/'::; J <br /> <br />ORD1.NI~NCE <br /> <br />N o. /3/8 <br /> <br /> <br />ORDINANCE ADDING SECTION 25.l.l TO TIm CODE OF THE <br />CITY OF REm'lOoD CITY RELNfING -TO CONCESSIONS PERMITS <br />vvITHIN !WNICIPAL PARKS }\ND RECREp.TION AREAS <br /> <br />THE COUNCIL OF REm'lOoD CITY DOES ORD)\IN AS FOLLOdS: <br /> <br />SECTION 1. section 25.l.1 shall be added to the Code <br />-.,.---- <br /> <br />of the City of H.edwood City, and shall read as follO\'lS: <br /> <br />"Sectio~~~ (a) <br /> <br />It shall be unlawful for <br /> <br />any person to vend or sell any food, beverages, novelties, <br /> <br />souveniers or other items in any municipal park or <br /> <br />recreation area unless such person shall have first <br /> <br />obtained a concessions permit to do so. <br /> <br />(b) A concessions permit shall be issued by the <br /> <br />City Clerk at the direction of the City Manager when the <br /> <br />City Manager determines both that the proposed sales <br /> <br />operation is a desirable adjunct to a specific activity <br /> <br />occurring within a park or recreation area and that <br /> <br />such sales operation will not unduly interfere with the <br /> <br />public use of the park or recreation area. No permit <br /> <br />shall be issued until after the Park Superintendent and <br /> <br />Recreation Director have had an opportunity to review <br /> <br />the application. <br /> <br />(c) A concessions permit may be issued for a specific <br /> <br />date or activity and in no event shall it be valid for more <br /> <br />than one year. The City Manager may establish such condi- <br /> <br />tions on the sales operation as may be ~ppropriate to protect <br /> <br />the public using the area and to protect the ovmers of ad- <br /> <br />joining properties, including times and methods of operation, <br /> <br />insurance coverage and indemnification provisions. <br /> <br />(d) A concessions permit fee shall be payable in an <br /> <br />amount established by resolution of the City Countil, <br /> <br />provided that the permit shall be issued without fee for <br />
