<br />5. Landscaping. The Permittee will either provide landscaping to screen <br />the condenser per City approval or contribute to a landscaping fund to the City for <br />purposes of installing landscaping within the easement. <br />6. Maintenance. Permittee agrees to maintain the condenser unit in a clean <br />and good working order; and the encroachment area clean, clear, and free of debris <br />and overgrown vegetation at Permittee's sole cost and expense. <br />7. Hold Harmless: Release. Permittee shall be solely responsible and <br />liable for all damages to persons or property, including injury to or death of, persons <br />and loss of use of property, due directly or indirectly to Permittee's use and occupancy <br />of the easement and shall defend, indemnify and hold City, its Council, officers, boards, <br />commissions, agents, employees and volunteers harmless from any and all suits, <br />actions, damages, or claims to which City may be subjected by reason of said use and <br />occupancy of the City easement hereunder. <br />8. Insurance. Permittee shall maintain at all times during which this permit <br />remains in effect, at Permittee's sole cost and expense, commercial general liability and <br />property damage insurance, which insurance shall be in the following minimum <br />amounts: <br /> <br />(a) $1,000,000 for injury or death of anyone person and $1,000,000 for <br />anyone occurrence; <br />(b) Property damage insurance in the amount of $1,000,000 <br />A certificate or certificates evidencing the maintenance of the required <br />insurance or program of self-insurance shall be deposited with the City Clerk prior ton <br />3 <br />
