12/10/65 WHK:yc:2/21/66 ~ ORD1.NANCE N o. :1235 ORDINANCE ADDING ARTICLE V TO CHAPTER 11 OF THE CODE OF THE CITY OF REDWOOD CITY RELATING TO THE GRANTING AND REGULATION OF FRANCHISES FOR THE OPERATION OF COMMUNITY ANTENNA TELEVISION SYSTEMS IN THE CITY OF REDWOOD CITY THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. Article V is hereby added to Chapter 11 of the Code of the City of Redwood City, to read as follows: "Section 11.70 "ARTICLE V :(a):')It shall be unlawful for any persons to construct, maintain or operate a community antenna tele- vision system utilizing any street or any other public property of the City unless a franchise therefor has first been obtained pursuant to the provisions of this Article, and unless such franchise is in full force and effect. "(b) It shall be unlawful for any persons to construct, maintain or operate a community antenna television system ,\ utilizing any street or any other public property of the City without complying with the provisions of this Article and all conditions of a franchise granted hereunder. "Section 11.71 For the purposes of this article, the following terms, phrases, words and their derivations shall have the meaning given herein: " (a) 'Grantee' : The persons, firms or corporations to whom a franchise is granted under this Article and the lawful successor or assignee of such persons, firms or corporations. . " (b) 'street' : The surface of, and the space above and below, any public street, road, highway, freeway, lane, alley, court, sidewalk, walkway, parkway, drive or public utility easement, storm sewer easement, or sanitary sewer easement now or here- after existing as such within the City. " (c) 'Community Antenna Television System,' hereinafter referred to as 'CATV': Coaxial cables, wave guides, or other conductors and equipment for providing television service by cable or through its facil- ities as herein contemplated. "(d) 'Subscribers' : Any person or entity receiving for any purpose the CATV service of the grantee herein~ " (e) 'Gross Annual Receipts': Any and all compensation and other consideration in any form whatever and any contributing grant or subsidy received directly or indirectly from subscrib~rs or.us~rs in p~yment for television signals rece1ved w1th1n the C1ty.
