<br />WHK:yc:2/2l/66 <br /> <br />"Section 11.72 <br /> <br />(a) A nonexclusive franchise to <br /> <br />construct, operate and maintain a CATV system within all or <br /> <br />any portion of the City may be granted by ~he Council to <br /> <br />any person, firm or corporation, whether opera~ing under an <br />existing franchise or not, who or which offers to furnish <br /> <br />and provide such system under and pursuant to the terms an~ <br /> <br />provisions of this article. No provision of this articlece <br /> <br />may be deemed or construed as to require the granting of a <br /> <br />franchise when in the opinion of the Council it is in the <br /> <br />public interest to restrict the number of grantees to one <br /> <br />or more. Any franchise granted pursuant to the provisions <br /> <br />. . <br />"' <br /> <br />of this article shall authorize and permit the grantee to <br /> <br />engage in the business of operating and providing a CATV <br /> <br />system in the City of Redwood City subject to the provisions <br />of all local ordinances concerning the erection, installa- <br /> <br />tion, construction, repairing, replacing, reconstructing, <br />maintaining and retaining in, on, over, under, upon, across <br /> <br />and along any public street or highway, poles, wires, cables, <br /> <br />conductors, ducts, conduits, vaults, manholes, amPlifl'ers, <br />attachments, and other property as may be appurtenant to <br /> <br />, I <br /> <br />the CATV system: and in addition, so to use, operate and <br /> <br />'provide similar facilities or properties rented or' leased <br /> <br />from a public utility franchised or permitted to do business <br /> <br />" <br /> <br />-2- <br />
