enforce any of the foregoing provisions, Lessor shall have the right to do so and that the <br />tenant shall reimburse Lessor for any fees and costs which it incurs in connection <br />therewith. <br /> <br /> 21. TERMINATION UPON DEFAULT. In the event Lessee shall fail to pay <br />the rents provided for herein as they become due, or otherwise fails to fulfill the <br />conditions and covenants contained in this Lease, or any or either of them, Lessor in <br />addition to any other rights or remedies it may have at law or in equity, but subject to the <br />rights of any Lender under Paragraph 15, shall have the option after giving written notice <br />of such default to Lessee and to each sublessee, pursuant to Section 1611 of the Code of <br />Civil Procedure, of temdnating this Lease and declaring said Lease forfeited and the term <br />hereof ended, unless, within ten (10) days thereafter with respect to any monetary default <br />Lessee shall cure said default, or shall cure within thirty (30) days in the case of a non- <br />monetary default, provided if the nature of the default is such that it cannot reasonably be <br />cured within thirty (30) days then Lessor may terminate this Lease and declare the Lease <br />forfeited and the term ended only if Lessee does not commence the cure of such default <br />within said thirty (30) day period and pursue completion of said cure with due diligence. <br />In such event, Lessor may commence legal proceedings to remove all persons and <br />property from the Leased Premises, and may recover from Lessee all damages it may <br />incur by reason of the breach of the Lease, including the cost of recovering the Leased <br />Premises, and including the worth at the time of such termination, or at the time of award <br />if suit be instituted to enforce this provision, of the amount by which the unpaid rent for <br />the balance of the term exceeds the amount of such rental loss which Lessee proves could <br />be reasonably avoided.
