dispose of same in any manner allowed by law. In the event Lessor reasonably believes <br />that such abandoned property has no value, it may be discarded. <br /> <br /> 22. CONTINUANCE UPON DEFAULT. In the event Lessee shall fail to pay <br />the rents provided for herein as they become due, or otherwise falls to fulfill the <br />conditions and covenants contained in this Lease, or any or either of them, and Lessee <br />has abandoned the Leased premises, Lessor in addition to any other rights or remedies it <br />may have at law or in equity, shall have the option of continuing this Lease. In such <br />event, Lessor may enforce all of its rights and remedies under the Lease, including the <br />right to recover the rent as it becomes due, and may in accordance with Section 1954 of <br />the Civil Code, re-enter said premises in order to maintain, preserve, or re-let the <br />premises. <br /> <br /> 23. NON-WAIVER. No waiver by Lessor at any time of any of the temts, <br />conditions, covenants or agreements of this Lease or of any forfeiture shall be deemed or <br />taken as a waiver at any time thereafter of the same or any other tem~, condition, <br />covenant or agreement herein contained, nor of the strict and prompt performance thereof <br />by Lessee. No delay, failure or omission of Lessor to re-enter the Leased Premises or to <br />exercise any right, power, privilege or option arising from any default, shall impair any <br />such right, power, privilege or option, or be construed to be a waiver of any such default <br />or relinquishment thereof, or acquiescence therein, and no notice by Lessor shall be <br />required to restore or revive time as the essence thereof after waiver by Lessor of default <br />in one or more instances. It is agreed that each and all of the rights, powers, options, or <br />remedies provided by law are cumulative, and that exercise of one right, power, option or <br />remedy by Lessor shall not impair its rights or any other right, power, option or remedy. <br /> <br /> 24. HOLDING OVER. Should Lessee hold over the Leased Premises after <br />expiration of the term, or after this Lease has terminated in any manner such holding over <br />shall be deemed merely a tenancy from month to month and at the rentals herein <br />provided, payable proportionately monthly in advance as to basic rental, but otherwise on <br />the same terms and conditions as herein provided. <br /> <br />17996.00003XBGLIB 1\1085097.9 21 <br /> <br /> <br />
