<br />REG:Yc: 5/4/65-7 <br /> <br />ORIGINAL <br /> <br />o R DIN A N C E N O. <br />--------- <br /> <br />-1. .~ n.j"-' <br />-,.;~. \<\ <br /> <br />ORDINANCE REPEALING ARTICLE IV OF CHAPTER 29 OF, AND <br />ADDING ARTICLE IV TO CHAPTER 29 OF, THE CODE OF THE <br />CITY OF REDWOOD CITY, RELATING TO EXCAVATIONS AND <br />PIPES WITHIN PUBLIC RIGHTS OF WAY <br /> <br />THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: <br /> <br />SECTION l. Article IV of Chapter 29 of the Code of the City <br /> <br />of Redwood City is hereby repealed. <br />SECTION 2. Article IV (commencing at ~29.45) is hereby <br />added to Chapter 29 of the Code of the City of Redwood City to <br /> <br />read as follows: <br /> <br />"Article IV <br /> <br />"EXCAVATIONS IN PUBLIC RIGHTS OF WAY <br /> <br />(a) It shall be unlawful for any <br /> <br />"Section 29.45 <br /> <br />person to open, or excavate in or undermine, or in any <br /> <br />manner to break up or cause construction within, any street, <br /> <br />alley, public utility easement or other public easement or <br /> <br />right of way unless such person first obtains an excavation <br /> <br />permit therefor. <br /> <br />neb) The provisions of this article shall not apply <br /> <br />to the construction of sewer laterals or other improvements <br /> <br />for which a permit is otherwise secured from the City or <br /> <br />to work being performed by a governmental agency. <br /> <br />"(c) The securing of a permit hereunder shall not <br /> <br />relieve any person from complying with all other regulations <br /> <br />and requirements, including franchise requirements, which <br /> <br />are applicable to the installation of improvements within <br /> <br />public rights of way. <br /> <br />(a) Applications for excavation <br /> <br />"section 29.46 <br /> <br />permits shall be filed with the City Engineer on forms <br /> <br />provided by the City Engineer. <br />
