CES:djk 04/04/90 (046/26) for a period of one (1) year after acceptance of the improvements by City's Council. a (d) If, within a period of one (1) year after final acceptance of the work done under this agreement, any improvement or part of any improvement furnished and/or intalled or constructed or caused to be constructed by Owner, or any of the work done under that agreement known as "Agreement for the Improvement of Parcel Map No. 88-14" (form dated 03/28/90), fails to fulfill any of the requirements of said agreement, or the plans and specifications referred to herein, Owner will, upon receipt of a request in writing from City directing the work to be done, without delay and without any cost to City, repair or replace or reconstruct any defective or othewise unsatisfactory part or parts of the improvement or work. Should Owner fail to act promptly to make such repair, replacement or reconstruction or to otherwise act in accordance with the requirement to repair, replace or reconstruct, or should the exigencies of the case require repair, replacement or reconstruction to be made before Owner can be notified, the City may, at its option, make the necessary repair, replacement or reconstruction or perform the necessary work and Owner shall pay to City the actual cost of such repair plus fifteen percent (15%). (e) Before the release of said parcel map by City for recordation, OWner shall deposit One Thousand Four Hundred and No/100 Dollars ($1,400.00) for plan checking, 3 11264
