Consumers All Items, 1982-1984 = 100 for the San Francisco - Oakland - San Jose - <br />CMSA, published by the United Department of Labor, Bureau of Labor Statistics (the <br />"Index"). The difference between the Index which is in effect on the date immediately <br />prior to the commencement of each Lease Year (the "Beginning Index") and the Index in <br />effect immediately prior to the commencement of the following Lease Year (the <br />"Extension Index") is to be used in determining the amount of the adjustment. If the <br />Extension Index has increased over the Beginning Index, the minimum rent for each <br />Lease Year ("LY") shall be set by multiplying the rent in effect during the previous LY <br />by a fraction, the numerator of which is the Extended Index and the denominator of <br />which is the Beginning Index. For Example, the rent for LY7 shall be determined as <br />follows: <br />LY6 rent X Index in effect on last day prior to commencement of LY7 = Rent for LY7 <br />Index in effect day prior to commencement of LY6 <br />And for LY8: <br />LY7 rent X Index in effect on last day prior to commencement of LY8 = Rent for LY 8 <br />Index in effect on day prior to commencement of LY7 <br />provided that the rent for any of the four LY (LY7 through LY 10) shall not be increased <br />by more than four (4) percent per LY over the rent in effect during the preceding LY. In <br />no case shall the rent during any LY be less than the rent in effect immediately prior to a <br />rent adjustment date. <br />Lessor shall notify Lessee of such adjustment by delivering or mailing a written <br />statement setting forth the calculation of the adjustment in rent. If the format or <br />components of the Index shall be changed materially, or if the Index shall be <br />discontinued after the date of this Lease, then Lessor shall substitute a type of index <br />which is published by the U.S. Department of Labor, the Bureau of Labor Statistics or <br />LeaseAgreement-CommunicationsSite-02/02/06 SITE #599A 3 <br />
