similar agency and which most nearly is equivalent to the Index in effect on the date of <br />this Lease. Lessor shall notify Lessee of the substituted index, which index shall be used <br />to calculate the adjustment to the rent unless Lessee objects in writing within fifteen (15) <br />days after its receipt of Lessor's notice. If Lessee objects, then the substitute index shall <br />be determined in accordance with the rules and regulations of the American Arbitration <br />Association. The cost of such arbitration shall be borne as determined by the American <br />Arbitration Association. <br />In the event that this Lease is terminated prior to the expiration of any Term, <br />Lessee shall be reimbursed for the remaining paid rent on a prorated basis (365 day <br />basis), subject to any offsets for past rent due or other costs, if any. <br />4. USE. <br />4.01 Permitted Uses. Lessee shall use the Leased Premises as one of Lessee's <br />mobile radio/telephone base station (a "Base Station") comprising Lessee's system (the <br />"System") for furnishing the mobile radio/telephone service to the public. A Base Station <br />is a site at which radio and telephone equipment is installed and used to send and receive <br />radio signals to and from mobile radios and telephones and to connect those signals to <br />telephone facilities either directly, by means of cables, or indirectly, by means of <br />microwave transmitting facilities (including microwave antennas) located at the Base <br />Station. Lessee shall not use the Leased Premises for any other purposes without the <br />written consent of Lessor. <br />The installation of any of Lessee's facilities, equipment and improvements shall <br />be subject to the reviews, approvals and requirements set forth in Paragraph 5.05.
