Subsection 1.2 Repair and Maintenan~!e of Common Area Damaged <br />by Pests and Organisms: The Association shall be responsible for <br />repairing, replacing, or maintaining the Common Area, other than <br />exclusive use cor~aon areas, with respect to any damage caused <br />the presence of wood-destroying pests or organisms. <br /> <br />Each owner of a Lot shall bear the costs of any damage to his Lot <br />or r~sidence caused by the presence of ;ood-destroying pests or <br />organisms. However, by a majority vote of all Lot owners, such <br />responsibility may be delegated to the a~sociation which in turn <br />may levy a special assessment to recover such costs. If such <br />vote is taken, and the Association assumes responsibility for such <br />maintenance and repair, the following shell apply: <br /> <br />(1) The Association may cause the temporal{ s~ry removal of any <br />occupant of a Lot for such periods and ~t such times as may be <br />necessary for prompt, effective treatment )f wood-destroying pests <br />or organisms; and <br /> <br />(2) The costs of temporary relocation during the repair and <br />maintenance of the areas within the ~esponsibility of <br />Association shall be borne by the individlal Lot owner; and <br /> <br />(3) The Association shall give notice of the need to temporarily <br />vacate a Lot to the occupants and to the Dwner(s), not less than <br />fifteen (15) ~ys nor more than thirty (30] days prior to the date <br />of the temporary relocation. The notice sh~ll state the reason for <br />the temporary relocation, the date and time of the beginning of the <br />treatment, the anticipated date and ti~e of termination of the <br />treatment, and that the occupants will be r. asponsible for their own <br />accommodations during the temporary reloc~ltion; and <br /> <br />(4) Notice by the Association shall be de~d complete upon either <br />personal delivery of a copy of the notic9 to the occupants, and <br />sending a copy of the notice to the owners', if different than the <br />occupants, by first-class mail, postage pre]~aid at the most current <br />address shown on the books of the Associati )n or by sending a copy <br />of the notice to the occupants at the Lot ac dress and a copy of the <br />notice to the owners, if different than the occupants, by <br />first-class mail, postage prepaid, at th~ most current address <br />shown on the books of the Association. <br /> <br />For purposes of the ~bove sections, "occ~pant" means an owner, <br />resident, guest, invitee, tenant, lessee sublessee, or other <br />person in possession of the Lot residence. <br /> <br /> 10 <br /> <br /> <br />
